DMCA & Copyright

How PeakClips handles copyright takedown notices and counter-notices.

PeakClips respects intellectual property rights and expects its users to do the same. This policy describes our procedures for responding to claims of copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

1. Reporting Copyright Infringement

If you believe that content published through PeakClips infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the allegedly infringing content and its location (URL or sufficient description).
  • Your contact information: name, address, phone number, and email address.
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  • Your physical or electronic signature.

Send DMCA notices to: hello@peakclips.tv with the subject line "DMCA Takedown Notice."

2. Our Response

Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing content promptly.
  • Notify the user who published the content.
  • Log the complaint in our repeat infringer tracking system.

3. Counter-Notice

If you believe content was removed as a result of a mistake or misidentification, you may submit a counter-notice to hello@peakclips.tv. Your counter-notice must include:

  • Identification of the content that was removed and its prior location.
  • A statement under penalty of perjury that you have a good faith belief the content was removed as a result of a mistake or misidentification.
  • Your name, address, and phone number.
  • A statement that you consent to jurisdiction in the federal district court for your address, or if outside the US, in any judicial district where PeakClips may be found.
  • Your physical or electronic signature.

Upon receipt of a valid counter-notice, we will notify the original complainant and may restore the content after 10 business days unless the complainant seeks a court order.

4. Repeat Infringers

PeakClips has a policy of terminating accounts of users who are determined to be repeat infringers. An account may be terminated after two or more substantiated DMCA complaints.

5. Note on Twitch Clips

Twitch clips are short excerpts of streamer-owned broadcasts. If you are a Twitch streamer using PeakClips, you represent that you have the right to distribute clips of your own content. If your broadcast includes licensed music or third-party content, you are responsible for ensuring you have distribution rights. PeakClips is not liable for copyright claims arising from third-party content embedded in your broadcasts.
